Temporay Emergency Custody

My daughter was just diagnosed with asthma and the dr said she needs to be in a smoke free enviroment. My ex smokes and when I get her for my parenting time she smells of smoke so bad I have to actually change her clothing before taking her out anywhere
The dr gave me a letter stating her diagnosis and that she be in a smoke free enviroment

can i petetion the court for emergency full custody until our custody modification court date arrives?
as if so how long after the petition is filed does it take to get temp custody ususally?
