The primary parent dies does the custody of a 16 yr old child go to the secondary parent?
The 16 year old child has been living with the father and grandmother and now the father has died so the mother now wants custody of the child. The child, father and grandmother has been living in Texas and the mother has been living in Indiana. And the father and grandmother has keeped the child away from the mother. I thought the law was "if the primary parent dies does the child goes to the secondary parent"? Is this true for either state Indiana and Texas? But since the child is 16 does she have a say in who she wants to live with?
