Virginia Child Custody

My Aunt and Uncle have been arrested several times in the past 9 months (physical abuse / violence) and have lost and regained custody of their 3 children to each other in the process. Recently the Norfolk City Police arrested both of them again and relinquished physical custody to my wife and I who are their only other family in the state of VA. We filed a petition for custody with the juvenile court and are awaiting our summons. I received a call from my Aunts sister who lives in Pennsylvania and she wants to come and get the kids. I am concerned that she will just turn them over to my aunt again and the kids will be in the same situation all over again. What are our rights and her rights? Can she demand the children and remove them from the state?

She can't just take them from you. If she keeps harassing you, file a restraining order preventing her from coming within contact with you or the children. You might want to contact the court to see if they can expedite the court date. Good luck.
