Visitation Contempt Order

My husband & his ex has joint custody of their sons,aged 6 & 9.The ex has refused visitation rights.She left the state of Texas on Tuesday & went to Washington state with them.She's suppose to keep in contact with their Dad & let him know where the children are at all times,even if it means moving out of the state.How can we go before a judge w/o a lawyer to file a contempt and make her bring the children back to Texas ? Can the ex-wife be charged with kidnapping because she left the state ?

If it is stipulated in the divorce degree that neither parent can move out of state with the children,you can file against her for contempt of court. If there is no stipulation then you will have a harder time getting her to move back,it can be done but it can cost you alot of money. The courts make it sound easy to be able to do anything in regards to moving out of state,what they don't say is how much it a cost you to get them back. If you go on line under custody rights and type in your state they will have answers to any questions you have, I would start there.
