You can get a restaining order againt the parent. All you have to do is report this to the police and he will be in contempt of court. He can get arrested for this. Call the school and make them aware of this order though the court, and tell them he is not to be near her and to call the police if they see him anywhere near the child.

Tomturkey,
Thank you so much for your reply to 'How do you stop a non-custodial parent with suspended visiting rights from visiting?' Your suggestions are great we will make the school aware of this order. However, when we tried to get a restraining order through the court, the judge said the non-custodial parent was acting just below the level of a a retraining order. The judge then suggested calling the police and making a citizens arrest. This is problematic because without a clear cut restraining order it means we are asking the police to interpret exactly what suspended visitation means and how it applies in public places. This might work out well or it may not work out. Because it is not as clear cut as a restraining order, we are reluctant to use a citizens arrest. Perhaps I am wrong and the police will understand the significance of a suspended visitation order. Do you or does anybody know if a citizens arrest will work in this case?
