How old do you have to be to divorce a non-custodial parent?

My daughter is 12 and she wants to 'divorce' her non-custodial parent because she doesnt like him, he isnt very nice to her, and its screwing up her life because its only been the past 2 years! He didnt even take it to court till then. I was never married to him, we never lived together and her daddy has always been my husband whom I married while pregnant with her. The non-custodial parent never had much to do with her because of his own desire. She was always involved in beauty pageants, competitive cheerleading, gymnastics, young marines, and so forth. But, because of her disrupted schedule she cannot persue any of these things anymore, most of which could help her with high school and possible scholarships to college.
But, she wants to legally 'divorce' him so she doesnt have to go there anymore. Can she do that? By her choice? Maybe by testifying herself? what would we need to do?

I am looking for an answer to that myself. My daughter is 12 also and has not gone to see her Dad for almost a year now. At first he refused to have her because he was so frustrated by her "girl nonsense" .. That means not being comfortable with him as she is with females. Being a conscientios student and involved with sports.She says he yelled at her for 4 hours because he had to interrupt a long weekend vacation. His house is dirty. His wife tried to appeal to her to visit by saying she is on a cleaning strike and she needs her help.
Anyway, he has not won her over. I am staying on good terms with him because my son visits. i am not preventing her from seeing him or alienating her . He is doing that . She wants to move far away, she wants me to only have custody but I know there still has to be visitation so no point there.
I don't think he can make her like him or want to see him even if it is the law. I have managed to bring the two together . She only would have dinner if I was there. I would like to know myself if she could legally divorce him.
