I am about to start fighting for custody and want to know my chances?

I live in SA and have a 3 and a half year old child. My husband and I have been seperated for 20mths. He has no job and is living with the family of his 17yr old girlfriend. I recently found out they are selling and using drugs. He has no license. He is threatening to take me to court for visitation rights to our child after I told him she would not be staying with him in that house and around these people. I want to know what my chances are, will he be given visitation rights with her? I am terrified I can't prove what I know about these people and the life he is living. What do I do what is my best chance at fighting him with this and how long is it likely to drag on for in court, will he win?

You need to file for sole custody of your child. If he has know job chances are he is not going to file his self. You can call legal aide and see if you quality for free legal services they go by your incom . You can find legal aide in the blue pages under government. You will want to do this asap. Until the court gives you custody neither one of you have it,so he can also try filing before you do. The child is now in your care i would not allow him to take the child until it has been ordered though the court that will prevent him from trying to keep the child. When you file for custody you can tell the judge that you know that he is doing drugs and the court can order a ramdom drug test. If he has any drugs in his system the court would order him to go to rehab before giving him any visitation or while he goes they can order supervised visits. They will take what you say in consideration even without proof. I would not waste time delaying on this. Good luck
