If dad moves out of state and has never abided by the court ordered visitation, can he just show up out of no where unschedued and take our child. It just so happened to fall on a court ordered visitation date.

If dad moves out of state and has never abided by the court ordered visitation, can he just show up out of no where unschedued and take our child. It just so happened to fall on a court ordered visitation date. I stay in TX he Moved to Atlanta. I do not have any contact info for him besides a cell phone number. He showed up after the due date on the court order and now wants to take our child. He was suppose to notify me in April and did not, therefore it defaulted the pick up date to June 15, Dad did not call notify etc. He showed up on my door step on June 19 advising that he was taking our child for the summer. Although he is suppose to have her in the summer, can he do this. What can I do?

If it is stated in the divorce degree that he gets her for the summers then he can. But if he is living out of state and if is not stipulationed that he can take the child out of state then no he can't take them only if he has a place to take them in your state. You can always go back to court and have the orignal court orer modifled.
