I'm the aunt of a 3 yearold his mother's sister me and my husband took care of him 80% percent of the time because we wanted too now child services took him from her put him in foster care for 6 months with my daughter and husband now the father came in has never been in his life until he was going to have to pay child support and the judge gave him to him he thinks of us as his grandparents he calls us mammie and pappy my parents are dead he never new them do we have any rights we trying to find out if we have a chance to get visitation if we need to get a attorney or if it's a waste of time barbara from tennessee

Well as far as the father getting custody of his children the law always gives the other parent the right for custody,if they can't or don't want custody then the grandparents or a family member can file for custody. That courts will not likely over rule that custody to give to the grandparents from the father. (Grandparents Rights In Tennessee) It's only natural for a grandparent to want to be a part of their grandchild's life-to watch them grow,and to see that they are being raised well. However,if a parent who is fit to raise a child doesn't want the grandparent to see the child,for whatever reason,there is little that the grandparent can do legally. BUT IF-their son or daughter dies unexpectedly,leaves or becomes unfit to care for the child, and the grandparents do have options available. If it can be established that there has been"significant relationship" between the grandparent and grandchild,then they can be awarded certain visitation rights.
