Videotaping Visitation Hand Offs

My sister in law is in the middle of a nasty custody battle with a former boyfriend who is abusive. He also happens to be a police man and uses that power to try and get us in trouble or harrass us. After a nasty confrontation a few months ago we started escorting her to all pickups at his house and videotaping the hand offs since he'd on numerous occasions attempted to file charges or threatened to sue with crazy allegations. We never leave the car, nor go on his property or even speak to him during the hand offs. In this case, is it legal to video tape like this to protect us from his false allegations? He also is violating the agreement since he often refuses to hand over the child at the time the visitation should end. He has threatened to sue us or press charges if we keep escorting her and videotaping.
