Visitation without custody agreement

My son's father is an alcoholic. We went through court proceedings and supervised visitation a year ago. For the past year I have allowed him to see him during the day when he is in town, which is about every other weekend, with the condition that he return him at night when he drinks the worse. He now wants to take him for a weekend with his new girlfriend. He is still drinking heavily. We have no custody legally worked out because after the last temporary agreement expired he did not pursue the paternity papers that were filed by his lawyer and the case was not dealt with. Do I have to let him take him?

No, without a custody agreement you can do what you feel is best. Maybe allow them overnights if in a few months he's still dating the girlfriend, but you should wait until that's a stable relationship first.
