Want to adopt my stepson

My 2 year old stepson was born in Canada to my wife who at the time was married to a different man in the us. The father of my stepson is a Canadian citizen who has failed to support my stepson. My wife has court documents stating that she has full and sole custody of my stepson and due to Michigan law recognizes The ex husband as the legal father. He has said that he would waive his parental rights so I will be able to adopt Danny as my son. The biological father is abusive and only wants to show off his son rather then doing anything to take care of his needs. The only documents he has his is name on the Canadian birth certificate. Which from what I understand the Canadian hospital never asked if my wife was married.

I don't think you should have a problem. You stated the father is willing to waive his rights, so if your wife wants it and you and the child does go for it.
