Wewould like guardianship of our granson he is in Sayre OK how do we begin the process

Our daughter has 2children different fathers. She has been abused by her daughters father his name is James, and has since married another man his name is Justin.
The courts in OK want to give James her son who is not his child. He is violent and does not care for the son (Tryston who is 6) and does not treat him as well as his daughter. We are afraid for his safety and would like to get him back to Oregon to live with us. How do we start the guardianship process?

First, if he is not on the birth certificate and not the biological father, or adoptive father he has no rights to the child and she can simply say no. The courts won't give them to him.

Your daughter can go to court and file for emergency custody to keep the children away from James if he is a danger to them. Then she can file for sole custody where he may only get supervised visitation so he be a threat to the children.

In OK they DHS is pushing for the children to stay together, They both have had legal problems there. they were both required to take drug classes.She is in the process of finishing her classes and he did complete his. The state has taken temporary custody of the children. James has family there and my daughter is alone and lost. We are so afraid of never seeing Trystan again and we are afraid for him. How do we start guardianship papers or what ever it is we need to do.

In the state of Indiana, we went to see a lawyer and explained the situation and the lawyer took our case. It costs us $550. 00, and it took about 1 month to finalize everything in the courts and get our papers in the mail. But it went on the court records the day we went to court.

Our situation was:
My sister and her exhusband had been using and abusing meth and had been in and out of trouble for several years. The state never stepped in even though many family members called and requested them to. We too, were afraid for my nieces safety and well being. Finally! The next time my sister went to court, I took her and they revoked her bond, which sent her to jail right then & there. I had begged her for 3 months to write something out so if she did go to jail, I could care for the girls, she refused and then it happened! She told me to pick them up from school and take care of them. I did. We were married 16 years and no children and suddenly literally overnite we had 2.
That was May 04, she was in jail until Aug, 04, We started in July of 2004 with the lawyer and it was finalized on Aug. 5, 2004. We still have legal custody and the girls are now 15 & 12. They are thriving physically, mentally, spritually, and academically. They go to counseling 1/month now and are very well adjusted.

I would contact a local lawyer, most will do a free consultation, get his/her feedback on the situation and follow through. It may not be cheap, so you may have to call on family, friends, church, whoever, and get those children out of that situation. They derserve better. God Bless you and Good Luck!

My mother in-law wants to give my husband and me guardianship of my husband’s brother (15) and has agreed to sign any forms necessary. Where can we get a sample of a letter of consent of guardianship?
