What are my rights as far as keeping my daughter when custody has not been established?

I have a daughter that is 4 years old and the mother is married to another man although legally seperated since 1994. She is telling me because she is still married that I don't have any rights to my daughter. We have since seperated and I would like to take my daughter to live with me as the mother is unstable at this time. Do I have the right to do this or do I have to prove paternity first even though my name is on the birth certificate?
