What are surviving parents rights in Ohio?

My daughter's boyfriend was killed in a car accident. A month later she found out she was pregnant. She is due to give birth any day now. The dad's side of the family has done nothing but cause her problems, denying the child, calling her names and threatening her. She is afraid they will seek visitation rights. Is this possible even if he is not named on birth certificate? What are her rights?

If she doesn't list anyone as the father on the birth certificate, then the only way they could seek visitation rights (don't even know if that is an option in your state; "grandparents rights") is by requesting a DNA test. Good luck!

Talk to a lawyer! The baby should be entitled to benefits from social security due to the death of the father.

If he isn't listed on the birth certificate they have no rights and would have to prove via DNA it was his.
