What can I do to fight for custody when I live in a different state then my children?

After bad events with my childrens dad and going to mediation order by the court i decided to leave the state. I left having shared custody but I am not sure if I can go back and get them under my care. Their father had been abusive too me and only has one police report on him for that. What should be my next move? I am living currently in NJ and my kids are in FL with their father.

It is very hard to fight for custody across different states because all state's laws regarding custody are different. With the new jurisdiction laws though, since your children's residency is in Florida, you will have to file for custody for them. Also the fact that you left the state could cause some complications as far as it could technically be considered in contempt of court if your ex is really a jerk and wants to fight it since you are obviously not spending the time with them set in the custody agreement. This is one case where if you want your children back I'm about 99% sure you will need a Florida family lawyer unless your ex will make an agreement with you.

Good luck!
