What do I need to do to get temporary custody of my nephew?

My 3 year old nephew came to live with my husband and I about seven months ago. We initiated the converstation with his mother because we thought she was doing drugs (his father was in jail at the time and is now in rehab for drugs/alcohol). She denied the drug use, but willingly let him live with us. We never went through any custody changes because it was understood that it was only temporary (she was supposed to go back to school to get her degree so she could support the child, which she never did). At first, she came to see him almost every other day. Now it has turned to once a week or so. We recently (about two weeks ago) learned that she was fired from her job (she won't tell us why) and that she is selling perscription drugs (painkillers and such) as well as abusing pills, alcohol, and possibly cocaine or heroin. I have reason to believe that she is doing something with these drugs while he's with her (either using, selling, or buying). I'm worried about his well-being, but I'm scared to bring any of this up with her before we have custody for fear that she may take him away from us (which would be an awful situation for him since she doesn't have a job, stays out all night, is verbally abusive to him, and uses drugs). I have no hard evidence for this, only testimonies from family members that she has openly shared this info with.
