What would it take for my fiance to adopt my daughter when her father lives in another state?

My fiance would like to adopt my four year-old daughter upon marriage, but we live in Tennessee and her father lives in New Jersey. What steps would I have to obtain full custody and have my fiance be able to adopt her? More than likely he will fight the case, but he never sees her, and since I stopped harassing him to set up phone calls, he has only spoken to her once. He does not pay child support and plays no part in her upbringing, while my fiance supports her and takes care of her. We feel that since he does all the work and is the one around giving her love, he should be able to be secure in having her even if something should happen to me.

In order for your finance to adopt her, her father will have to relinquish his rights. You may be able to have them involuntarily relinquished on the grounds of abandonment. Then you go through the adoption process where there will be a hearing and then papers to sign.
