WOW! Sounds like he is doing pretty good for getting social security benifits. I am not aware of the state that you resde in, but to be honest I have never heard of a grace period on child support, and would be more likely to tell you that this is probary hear say and not fact. Depending on your state child support can be reviewed, in some states every 2 years and some every three years. However if you were ordered to pay child support and you are not making the same amount of money as when the order was put in place by law you can file a motion and ask the court to lower your payments. Your child support should of been determined by both of your incomes even if it is social security on the fathers income. I can tell you this if you are owing back child support errears then you are not going to get out of paying those errears off, the court will not take off those childsupport errears, even if you get your child support lowered. You can call the child support services and try to make a reasonable payment plan to catch up, and this is in the best interest for you, because the child support servies can suspend your drives licence for back errears,, if you owe as low as $500.00 in back errears. If the father recieved his share of the profits of the sell of your home and he recieved part of your 401K that cannot be included in child support. That was a divorce settlement.
