Who has legal custody of a child born to an unwed woman?

My sister had an unplanned pregnancy with a man she does not want to marry. He is a decent father to the now 20 month old, but is beginning to ask questions like "Why do you get to be the primary care-giver?". What custody rights does a man have to a child born out of wedlock? We all still live in Virginia, where the child was born.

If his name is on the birthcertificate he has full legal rights to that child. If his name is not of the birthcertificate he will have to prove paternity (his expense) and he will have to take you to court for custody. If he is on the birthcertificate and pays child support he has every legal right to that child.
