It does not matter if you are with him or not. You should still file for sole custody of the baby and have the court issue a child support order as well. I am not with my son's father either and I have sole custody of him. The only rights my son's father has is supervised visitation 1 day a week for 5 hours and he has to pay child support as well. Other than that he is to have absolutly NO contact with his son, me or my other 2 kids. I had a similar situation only he grabbed my 2 year old by the throat and was kicking and punching me while I was holding our baby trying to feed him. Trust me, no judge will refuse you sole custody if you tell them everything about it and what has gone on. They also do a background check as well.
