No, you can file without your spouse being involved. Be aware, however, that if you file on any debts that are jointly in your names or file on any medical debts that were incurred while you were married to your current husband, the creditor does have the right to collect on the debt from your husband. Also be aware that under the current bankruptcy code, you will probably also have to submit his pay stubs along with yours to the bankruptcy court, unless you are separated from him.
