Salaried employee overpaid, can deduction be made from commission?

My son works for a company who pays him salary, he works 10 to 12 hours daily, last week he was sick and they did not pay him. They do not pay him OT or hourly they pay based off 80 hours for 2 weeks

My employer tells me a "salaried employee" is the same as hourly, but they "just don't have to punch a time clock"

I would like to pick up hourly work hours. Is that legal?

She has worked less than 6 months for us. As a salaried exempt employee ( she makes $663.46/week) we ask that she work between 40 and 45 hrs/week.

Do I simply take their annual, divide it by 260 working days and then multiply that times the # of days they are working in their first pay period?
