Who handles restaurant negligence for raw food consumption

My 4 yr old son ate a raw cheeseburger at Wendy's

You have to report this right away. When he bit into it did he know? Where you watching him eat? If he ate the whole thing and didn't know then how do you know?

You really have to nip food problems in the bud as they happen. Go to the resturant right away and don't wait until the next day. If he gets sick go to the hospital for food poisoning.

The longer you wait the more time, the more people will not take you seriously because you didn't take the problem seriously.

You can file a complaint with Wendy's on the Franchise level and then on a corporate level but unless you have some proof all you are going to get is a sorry letter and a few free food coupons.

If he gets food poisoning and they can prove medically or phyisically that it was wendy's then you can sue for medical bills and such.

I'm sorry your son had this happen but you need to take action and responsibility for what your child eats. I hope this turns out well.

Hey I wanted to respond to you... He didn't eat it all only about 1/2 before I realized ... also, we did speak to the manager he wrote on our receipt his manager # and gave some of our money back... and I kept the cheeseburger, I did not give it back to them like I am sure he would have liked. What kind of attorney handles this?

You could go to a general attorney but if you child doesn't get sick as a result I'm not sure it's sue worthy. More something to take up with the wendy's.

I think your best bet is to handle it through the wendy's corporation and make sure it doesn't happen to anyone else's child.

ALRIGHT You to know that they will always point to somebody eales , but the person working the grill[cooking the burgers] but the lead person had to know who was working where and how and if thier busy lead person will jump in to where ever they are need [the grill?, or casher or fries or drive thru] so then his attention may not be on that they are being under cooked > THEN the Manager or Asst. Managers in charge on that shift is the bottom line ,and will have to step up cause it's going to fall on to him/her, yes the grill person [who must grill with a timer like the fryers ?] and the lead person is going to get chewed out , But the Mang. or Asst. are going to answer to somebody be a Gen. Mang*/ owner*/ Company* and back to that finger pointing earlier, that is starting there and down it goes the Mang. / Asst.- is answer to the big #3* and that could be any or all of them, then they are the leaders who will problemly be hit the hardest [he made the above look bad & then the Kid is just shrugging his sholders] the kid will be back to the Fryers or something till they will hold training too asure that another burger never gets undercooked again [till the next time] I hope that helped you and didn't tell you alot of crap you didn't need, but it's there just like any other place, and just that is where they learn to know to pass the buck and ready for the world.
