The herpes virus can only live for a very short period of time outside of the body. For example, if a person with active genital herpes sat on a toilet seat and spread secretions from an open weeping sore to the seat, you would have to sit on the same seat right after that person got up. In addition the secretions on the seat would have to enter an open wound on your body for you to be at risk. In theory it is possible to get herpes from a toilet seat, but very highly unlikely.
