Must an employee be employed for a minimum of year to be eligible

My wife was injured in a motorcyle accident and has been on unpaid personal leave since February 9,2008. She still needs additional time off. But her employer has told her that she is not eligible for FMLA because she has not been employed for a year.

Per Federal Law, to qualify for FMLA a person has to be employed for at least 12 months AND has to have worked at least 1250 hours during that 12 months. So her boss is correct, she is not eligible. Sorry, Susu

Making progress but still has a long way to go. But at least the LTD has finally been awarded staring next week retro to May at 1/2 her monthly salary. So thanks again.
