How long can an employee be considered seasonal?

How long can an w-2 employee that is hired on as seasonal for a job that has a short span that turns into a longer time be considered seasonal. What I mean is that a seasonal employee does not have benefits. So what time frame is legal for an employee to stay on that type employment?

More than likely he is a contract employee there fore no benifits his status would have to come from the co. to a full time employee for him to receive benifits
