Claim Sibling/Nephew

My mother passed away on 7/6/07. My sister, nephew and I live in the house where rent has been paid for the next 1.5 years. My sister did not work in 2007 taking care of my mother, who died from kidney/heart problems. I have been paying the bills for utilities, phone, etc. I turned 47 on 8/15/07. Can I claim my sister and nephew (she just turned 45 on 11/8/07 and my nephew who just turned 15 on 11/22/07 on my taxes for 2007)?

You can claim your nephew because he is a "qualifying child" if you have been paying the support for more than 6 months this year (I wasn't sure if you were working and supporting them while your mother was still alive). If you are single you can claim head of household which offers more benefits that filing single since you have a dependent. If your mother was also completely disabled, then you could claim her as well as a "qualifying relative".

Your sister would have to be disabled to claim her, but you should get a break with the nephew and your filing status.

Well as far as I know when I filed tax return at any of the companies they have asked me before if we have anyone living with us and they told me it is anyone who is depended on you just like it is in your situation. If they are dependent on your income than they are your dependents who you can claim. This is what I've been told by the income tax guy. You can claim them for as long as you supported them and you need some sort of proff of expencess which should not be a problem getting.
