EIC questions

I just got married and I been filling head of house hold. I have three childern none of them belong to my hubsand. but he wants to claim one this year can he? and no why or how do we need to do this.

You do not need to do this, the max # of children you can claim on EIC is 2, and you and your husband can not both file for EIC seperatly.

What income qualified people to claim the EIC?
1. A single person with two or more qualifying children and earned income under $33,692 may qualify ($34,692 for married couples) for a credit up to $4,204; or
2. An individual with one child and income under about $29,666 ($30,666 if married) may qualify for a credit of up to $2,547; or
3. People between the ages of 25 and 65 with no qualifying children and income below $11,230 (add an extra $1,000 if married) may also qualify for a credit up to $382.
Others:
4. Your investment income (interest) must be $2,600 or less.
5. Your filing status cannot be married filing separately.
6. There are citizen requirements.
7. You cannot be a qualifying child for another person.
