Did she pass away? Is there a will? Is she trying to give it to you or appoint you power of attorney because she cannot take of it herself?
No, she has not passed away....she is wanting to prepare.... She does have a will, and my sister is the executor.....She is able, at this time, to take care of her affairs. We have heard that there is some sort of 5 year period that has to pass (in the event SHE has to enter a Nursing Home)before we could legally take possession of her house in the event OF her death. In a nutshell, she does not want the property to sit for any length of time, and she wants the children to have the house now to avoid any hassle for the children.
My mother is of sound mind and good physical health....She is wanting to avoid any problems just in case she HAS to enter a nursing home. She has been told that:: If you enter a nursing facility your property (Home) could be taken by the State for payment TO the nursing facility for her care, unless the home is in someone else's name 5 (five) years prior to the entry date in the nursing facility. She does have a will that states in the event of her death the house will be equally distributed to the surviving children (or grandchildren, in the event of death to her own children).
