Can I be fired due to a health issue?

I have osteoarthritis of my left thumb and have been having trouble doing my job. I have told my employer many times about my problem and that I will be having surgery. He still insists that I continue to do things that hurt my left hand. I have a medical excuse from my doctor but did not want to give it to my employer because I still wanted to try to do my job. Yesterday he left me no choice and I gave him the note from the doctor. He said we have a problem now and that I cannot perform my job. What should I do? I think he is going to fire me on Monday.

Get an Attorney that specializes in employment and work place problems. It seems that you with held the note and then just gave it to him as a last resort. You are partially at fault here! I would go in and have a meeting with him and make suggestions on what you could do until the time of surgery. There has to be some job that you can accomplish with a sore thumb. Make that suggestion to him. Then if he refuses, contact a couple of attorneys and get the free initial consultation. I don't know if he can actually fire you for the medical problem. BUT, if you are unable to perform ANY job, he may be able to. You need to keep your job and medical insurance, so I would be doing anything I could do to stay there. Good luck.
