Can my manager fire me for auditting my cash register at the end of my shift?

I recently began working for a fast food resturant as a cashier. at the end of the day i am only allowed to count 100.00 dollars for the register and the rest of the money i have to put it in a bag along with the total of sales i made the day. when i first started i was told i could not count the remaining of the money and compare it to the total sales (in order to find out if im short or over )my boss approached me and told me if he catches me count the rest of the money he will fire me on hte spot. he claims he will let me know i the beginning of my next shift if i was in fact short or over in the register.. is this legal? what if he pockets some money and then says i was short and then i become responsible for paying the shortage of money? what can i do legally?

That's certainly an odd practise. I've worked in retail for quite a few years, and I've never heard anything like that. Mind you, the actual rules may differ from one place to another, so you will have to check with your province/state to see what they say. One place I worked quite a few years ago, I only counted the till at the beginning of my shift and the supervisors counted it at the end. They never approached me about any outages on my till at all. Every other place I worked, I was responsible for counting my till at the beginning and the end of the shift. I would have to sign off on my count and have it recounted by the supervisor. Are you able to be present while the manager counts your till? That would make me more comfortable about possible outages. I don't think it's fair that he's making you wait until your next shift, because how can you possible account for any shortages after the fact? When I was managing, if we had shortages, we would go through everything to help the employee find it, even as far as looking in the garbage cans (never found any money there, but we did find some stuck in the till once!). Two days after the fact, it wouldn't matter because you wouldn't be able to find it.

Thats my biggest concern... i am not allowed to be there when he settles my counts.. only he knows how much was actually in the register after my shift. when i worked in other places here in texas,i was supposed to count my register upon my arrival (in front of a supervisor),then we both signed to it. after my shift we would again do the same procedure. something i like to call "settling your register"i guess this company is a lil odd. i just hope it doesnt become a problem in the near future,bbecause now im extra careful with my cash,i started.counting backwards and it just makes my speed of service slower and the customers just wanna get there food and go..i guess they even made me doubt myself..its better to be safe than sorry.also i have to pay back all shortages..

I'd call the district manager of the chain and ask him what the policy is and tell him exactly what is going on and your fears. You can not be held liable for any shortages if you're not allowed to verify them. What you've done before at other businesses is the proper and accepted way according to Department of Labor Standards. My guess, your supervisor IS pocketing overages. There are ways to catch him at it, like front load a drawer with an extra hundred dollars and see if it shows up on the books.
