Employer/payroll issues

I have had direct deposit for a year with my employer. 2 weeks ago I left on medical leave to care for my father. My paycheck was not deposited as usual, and overdrafts were created. NO ONE ever said during the process of getting medical leave, that my paychecks would be affected in any way. I have an 80 hour check that I expected to be deposited as normal, and paid bills accordingly. Do I have any recourse on the overdrafts incurred? Because it is the weekend, I have not been able to contact anyone to see what the actual status of the check is. My bank said that by law my employer has to have my check to me by the actual payday. Is that true?

Are you sure you are eligiable to get paid for your medical leave? If not that would explain why your check was not despsited in your account. There is really know other explanation. my husband has direct deposit and even if you want to stop it yourself you would of had to sign a form at your work to have it stopped. I think frist thing Monday morin I would call my boss and see the status is . Presonally I have never heard of an employee getting paid for medical leave to care for a family member. Usally medical leave is just giving you the time you have ask for off with the opton to come back to work. My brother inlaw took off to care for his sister and got a leave of absence so his job position was still there when he came back.

The bank is correct it is illegal to withhold your check. You will have to follow up with your employer to make sure you get your medical pay and ask them to pay the overdraft fees. Most companies will comply but if they don't you may be out of luck because the over draft fees are not worth it to sue.
