What do I do to get a bad ck felony from 9 yrs ago removed. Trying for a new job & all of a sudden I am being denied because of this charge. I didn'

I had a bad ck fine in 2000. I have had several jobs with no problems since, but now I am looking for a new job and all of a sudden I am being denied the jobs due to this bad ck in 2000. I had been off work & my prior employer said they would hire me but my pay ck would not be worth it since I am a truck driver fr Pa and their headquarters are in Minnesota. Can you give me any advise? Thank you. Tom

Expunge/vacate this conviction? You need to go back to the court where this happened and have a lawyer file a motion to get this erased off your record and i would think the court will do this for you because if you haven't got into any more trouble then enough time has passed where you can get this one time felony taken off the record but you have to have this done with a lawyer filing this for you and he will know Whether you can expunge/vacate this conviction and the court to consider this motion now this is what this is for is a one time small felony like a drug charge or bad check charge and this is not considered bad really to hold this for life and you are a good case to get this done . so call a lawyer in the county or city this was in court with and start from that.

There should be an online website of the Code of Laws of your state. If not, go to your local library, and use the legal books in the reference section.

Each state legal code books have sections which mandate the time required before you can petition for an expungement for each specific crime. Many crimes, other than those linked to the most violent, have statutes which mandate a specific time of which a person may request expungement.

I recommend you do your own research, rather than hire a lawyer, to fill out a form and submit what you can do yourself, and save some money.

I would make sure you have a job and a stable place to live. Enroll in some school/college classes as well. After 6 months to a year, go to your local court house and tell the clerk you want to see a judge to expunge your record.

You will have to convince the judge that you are reformed or rehabilitated. Words are not enough... you will need to show the judge that you are trying and that it is standing in your way of getting a better job. Once you show the judge your grades in school, that you have a stable job, etc., and that you want to get a better job and continue with school, it is more likely that a judge will expunge (erase) or seal your record.

The more you can do to better yourself in terms of education, family, etc., the better you will look in court. Dress well. Say yes sir or yes ma"am or your honor, show documents of the school you are in and the schools you plan to go too. Bring information on the job(s) you want and how they will benefit you but that the only thing standing in your way is your criminal record...and that it was from a time when you were immature and selfish and young and that you just want to better your life now.

The good thing on your side is TIME! The more distance between you and conviction, the better! If you can show you have been doing great and staying out of trouble over the last 9 years, then you are more likely it get what you want from the judge.
