Bad back injury.problem

I did my back in at work last week. i didnt fill in the accident book at the time and my boss says because of this he will only pay me ssp. i have been to my doctor and she has given me a sick note relating to my back injury. but my boss wont accept it. i cannot afford to live on ssp as i cant pay my rent. i have been forced to return to work thiscoming monday 1st june when my back is still playing up and im not really ready for the heavy lifting my delivery job entails. i feel i have been had ovr a barrell. what can i do. please help!

OK now the boss is hardheaded seems like and knowing that if you come back hurt he is putting himself in line for a big lawsuit. and tell him that if you hurt yourself more that he will have to pay you regardless of what the outcome is . and he should respect you and help you when you were hurt doing the work for the company and its your body. ands you have take care of it and go and file a lawsuit to this affect tomorrow. and he can not put you back to work if a doctor says no . this is against the labor laws and call the labar board and tell them whats going on. and bring them to the work place . and they will come.

Thankyou very much for your reply. I must say that my boss hasnt forced me back to work early.My sick note says thursday.But i cannot afford to be off work longer (sad isnt it). I said to him atifi come back early and i hurt my back more he says he will just refer back to me not filling in the accident book and say that yhe original injury was not work related . To add insult to injury-literally- i am being made redundant in 8 weeks time as the company are relocating some 60 miles away.

Workers Compensation covers occupational related injuries- if a medical professional deems your situation was caused by the type of work performed. You are entitled to file a WC claim legally- this does not mean it will be accepted.... but it is of vital importance you do so. A witness to your injury is a key factor in work related injuries when one fails to fill out an incident report. If you are employed by more than one employer at the time of injury this will also cause need for very specific detailed information in regard to your injury. Each state has their own Worker's Comp court that will allow you to file a claim without assistance from your employer. You must write in a journal exactly what happend when you injured yourself as your record if the employer will not accept an incident report.
When a claim is not accepted by an employer it is an uphill battle that many require legal assistance to win.
Stay active and return to work as soon as you can as all medical research shows the quicker you return to work the better your prognosis. You are also protected by the American's with disabilities act (if you have been employed long enough) meaning your employer is mandated to assist you in providing assistive devices that can allow you to perform your job--- note: it must be fiscally possible for the company to do so and you have no legal ground if you cannot perform the job with acceptable accomodation.

If your back spasms up after you return you must complete an incident report. If one is not provided to you.... you must call your state labor department and they will ensure you receive one.

Your employer is not a medical professional and injuries that are aggravated by additional work are indeed coverd. If your have an ankle that is sprang and then you break it the next day.... it is not the same injury.
