Yes, there are many ways for a company to get around that. It depends on the company's on how well the company was doing when you got hired and how they were doing when the other person got hired. Plus, a lot of companies hire and pay based on experience and educational background. That is the most popular reason. Qualifications are a big thing now-a-days. In the end, if you are the better employee, you will get a raise and the other person who got paid more to start, but didn't work as hard or as well, will end up staying at the same rate of not get as much of a raise as you.
It may not be fair, but it is legal. Maybe it's time to ask for more money, or for a promotion. But you will need to review your accomplishments on the job and prove to your employer that you are worth more.
