Breach of contract - down payment not returned

A purchase agreement was signed for a mobile home and a 1200.00 down payment was paid. The seller was to purchase a new stove and refrigerator as part of the agreement. On the proposed delivery date, the stove and refrigerator were not purchased yet so the buyer did not complete the sale. The seller will not return any of the down payment. Is the buyer entitled to receive any of the down payment back?

And this is in writing that the above was the conditions of the sale?

I would think that the $1200 should be returned if the stove and refrigerator was not purchased.

The seller not only has breech the contract but may also liable for any cost that the buyer may have iccurred because of the contract breech. The buyer is definately intitled to a full refund of his deposit.
