Can this attorney do this?

I signed the final papers on a divorce in 12/2003. The attorney told me he did a non-contested divorce for $1700. I don't have this in writing, but my sister who used to work for him and is now also an RN was there. As I was a stay-at-home mom for the last 20 years and did not work; my ex-husband agreed to pay the alimony and child support payments taken from schedules. He also told me I wouldn't have to pay his fee as my ex would. Then he refused to ever put it into the divorce decree. I went back to school and became an RN and last year was my first full year of work. I have school loans, car payments, 5 children still at home I support; 1 in college and 1 in an FAA training program. My son, 23, who still lives at home, is trying to get started in his own business and cannot really add to our support at this time. I work extra on weekends to be able to pay our property taxes and rarely have anything left after helping out with children's car payments. This attorney threatens to sue me each year. He says I now owe him $4500 and I've been trying to pay him $50 a month except when I had to make children's car payments. I received a letter last week that said he will sue me if I don't pay in full by end of month. It also said that I haven't made any attempt to repay the loan. Every payment I make is eaten up with his interest add-on. It is like a nightmare credit card that just keeps increasing. What should I do?

Look over the agreement papers. Get a dependable laywer if it comes down to it. He may be just trying to milk you. Let him take you to court to see who is at fault. Verbal agreements will not stand up in court especially against a laywer so document eveything and read all paper work with your signature. This seems really odd.. there has to be some kind of legal paper work to the amount you owe.

If it wasn't in writing that your ex would pay for it all, then yes, he can. try and get on some payment plan with him to keep him from suing your talking you to small claims court to get the money from you.

it is possible that he could have the courts garnish your wages till you are all paid up with him.

Report him to the bar association for exhorbitant fees, also if he did not give you an itemized statement then you got him. He cant just send you a bill for $4,500 and not list what each cost item was for. Then you dont have to pay him at all. Also, you can let them know he did not finish his civil duty or your divorce properly and your children are suffering for it!

Do you have any written contract with this attorney? Request in writing he provide a comprehensive breakdown of his fees. Research the state bar association for complaints or reprimands, You have shown good faith. Most bar associations establish standard fees and have abitration processes when it comes to charges. Withhold filing a complaint until you receive a reply from the bar association. Remember the cult of attorneys does not like bad apples.
