Only the person themselves can legally file a will, other than a lawyer. I think as the executor you can take the case to probate court where more than likely the judge will award the money unless there is some dispute over it.

Can you file a will to probate without a lawyer?
In Indiana can you file a will for probate without a lawyer. Mother recently died, her will was carried out while she was alive, she was in nursing home. Lawyer wants nearly 1000.00 to file will, she only had 400.00 when she passed on. Can I, as the exe of her will file it myself?
