Can you give a child the fathers last name without nameing the father in the birth certificate.

My friend wants to give her daughter the last name of her father but doesnt want him listed on the birth certifcate. We live in California can she legally just give the baby any name with out the father being on it. Thanks

Yes you can give your baby the fathers last name without him being on the birth certificate. When the baby is born then you will want to file for sole custody if you annd the father are not together and you will need to have the court stipulate visitations for the father and child support will then be ordered. You will be ordered child support,however the father can take a parenty test to establised if he is the father and if he is not then the court will terminate child support. The law is that the burden of proof lys upon the father. So you are fine in doing this your way.

My friend does not want anyone listed as the father she wants to just say she does nt know who it is but still give the child his last name. She doesn t want him to have any rights to her I think is why but still wants her daughter to be able to carry his last name and if they asked in the hospital whos name it was she would say a friends or something but I thought that the would want someone to take legal responsibility as the father to this child if she dad that. Does anyone know..... Thanks so much
