Child support

My husband and his ex-girlfriend have a now 10 year old son. They don't have any official child support order, just an agreed upon amt between the two of them which he has faithfully paid since the birth of the child. I'm not sure what the Arkansas percentage for child support generally is ( we also have 2 children of our own living in our home) but we're wondering if she ever decided to take it to court, if we would be obligated to pay back child support if the amt he pays is not as much as what the court would order. or would it just be from the time of the court order forward. She would first have to ask the court to make a "retroactive" child support order, and this is not commonly done when there is an absence of a child support order to begin with. Make sure you are keeping good records of the amounts and times they are sent to her.

The court would probably not order back payments, since they had an agreement. By her accepting the checks all those years, the agreement was acceptable to both parties.

Maybe get copies of the checks proving that she cashed them, in case she ever says 'we never had an agreement'.
