Yes you can file for sole custody and I would do so ASAP. If you had a court order for child support you are entitled to prusue that if he is not paying. You should not of took him back for the reasons you did exspecialy since he is abusive. He is still obligated to pay for child support. When you file for sole custody let the judge know he is not paying child support, and that he went to jail for doemestic violence,and ask that he can only get supervised visits until you feel safe enough for you and the children to be safe around him.

Child support
I divorces my husband sept 03, he was suppose to pay child support. He never did for almost a year & family & children services could not help & child support inforcement would not help & said I needed to take him back to court. I could not afford to do that as a singe income with kids. I let him come back. He has been back & forth over the last couple of years so that I atleast would have that income. I had him put back in jail the other day again for domestic violance & drug use. His family sends messages that I will never see a dime again. He is a contractor with a 1099. I need to know if there is anything that I can do to get the child support & the orders in divorce followed. I also at this time would like to know if I can take him back & get sole custody as it seems that he will never completly stop doing the drugs or getting help with his violence.
