The father would be the first to have the right to get his daughter. If he has a history of being abusive I don't think at this time there is anything you can do because you said he has not seen his daughter in four years so you really don't know if he is the same person. I would think that he cares if he has come to get her. The stepfather would have know rights what so ever. The grandmother has know legal rights unless the father allows her to have them. If the daughter lives with her father and he does abuse her she can call child protective services and they will investagate. Then if they find that he is then she can ask to contact her grandmother and the court can appoint the grandmother custody.
