Could I sue the Texas lottery

I had my girlfriend go to the store while I was at work and buy me a 5 Mega Million lotto tickets on 11-24-2008 for the 11-25-2008 for an est. cash value jack pot of 62.2 million.
She used an authorized texas lotto Mega Million play slip, which has 5 play board A-E.WE planned to buy 5 and all the play board on the play slip were filled out correctly.
The problem occured when the slip was put into the official TX lotto machine it only gave us 4 tickets instead of the five. The tickets showed play board A,B,C and E the computer left out play board "D".My question to the lotto commission how is it possiable for one of ther machines to exclude play board "D" and take away my chance of winning the jack pot. What if the was the winning number combination of numbers that I needed to win the jack pot,I woul like them to prove it was not.Bad machines and bad training to clerks made it unfair for me to win and made my odd go even hire.I play the lotto to win and if the lotto commission cant prove that the "D" play board there machine delete wasnt going to be a winner, they should pay me the 62.2million by default.I am sure that board "D" could have been the winner it only take one row to win.I have the ticket and play slip in with me for review.I think the lotto should be fair and every one need to have an even chance to win.Thank you

Sorry to tell you guy, but the proof is in the pudding. Your girlfriend should have checked her playslip and her lotto tickets after she made her purchase. Malfunctions do happen. You cannot sue the Texas Lottery because you do not have any recourse. Otherwise every one that made a similar claim would be suing their state lotteries for the same malfunction.
Next time buy your own tickets, don't trust others to know how the game is played and what is expected if you are a winner. You should always make sure that you are playing your lotto game, verify your numbers on yourplay slip, and make sure that you get a reciept before leaving the store where you play. Your girlfriend is not responsible for your ticket either. Why didn't she check the numbers and the ticket before leaving the store?

Good luck
