Divorce and financial outcome.

Hi. I entered the US with my 2 children last May 2007 on a fiance visa. My husband and I married in July 2007. Both my children and I have recieved our permanent residence status. However, my husband now wants a divorce. He has admitted to one affair before we got married but I think there has been more since I arrived. Unknown to me, he was hugely in debt. So, when I arrived, I gave him a loan of $2,000. Shortly after that, we had someone arrive at his home with a court summons. He told me he had consolidated his debts but for some reason, it was not being paid to the companies involved. Because of his bad credit, we could not get a home big enough for all of us and his 2 children who spend every other week with us. So again, I gave him another loand of $5,300 to pay of the creditors, which he said he would pay back to me each month. I have not received any of it. We finally found a rent to buy home and I paid $15,000 for the deposit. He contributed nothing. I cover the bills and rent each month even though I am not working and he was suppose to give me £800 every 2 weeks to cover his half. This is very spradic and at present, he is approx $2,000 behind with the household payments. He has now informed me he is looking for a place to move to and leaving me with all the resposibilty of the house and said he cannot pay me back what he owes even though he has a good job in San Francisco which pays well. What are my legal rights?

Seems like you put in a lot of money into comulitive property. Since you willingly contributide to the marriage it becomes joint property. Unless you have on paper that you loaned the money to him. Other wise you surrendered it. If he only started making money after the separation you cannot take that away from him. How did you get the money to begin with. Seems like you had wealth before the marriage. The law states when a divorce is to take place each person should live the same status as when married. Seems like when he was married he didnt contribute. So why should he now. Only payments he needs to make may be child support. be careful you may need to pay him
