Do I have to have a lawyer draw up papers involving guardianship of a minor child?

My husband and I want to resolve the issue of where our son would go if something were to happen to us. We have friends in mind to be guardians, do we have to go through the courts and file papers, or can we just have some type of form set up and have a notary sign it? There is an older brother in the picture that the courts would probably award our son to if there isn't any paper work in place. The grandparents are not an issue.

No way - that can be very expensive!

We used this software called Nolo (nolo.com). It works like tax software in that it asks you questions in a step by step format then drafts the legal paper work. Then simply print, take to a notary (about $30-$50 - if you belong to a credit union they may offer this as a free service) with your 2 witnesses and it is just as legal as anything a lawyer would charge at least a few hundred dollars to draft.
