Do we have any legal rights!

We received a 2 year old little girl a year ago, she is my husbands cousins daughter. None of the grandparetns wanted her and dad was in prison and mom was going to jail. Her mother physically abused her, and there is a history of abuse, drugs,etc.. they have had their children taken away twice before. In a year they have sent no money, christmas gifts , birthday gifts, etc... they just got one of their children back and now want the little girl back. She is so terrified of her mother, she dosen't even call her mom, she calls her the "bad lady". While dad was in prison the mom was homeless, shoting up meth, living with her drug dealer boyfriend and dragging this little girl all around while she did her drugs. The little girl has told the therapist about the abuse her mom did to her, and how scared she is of her. The therapist recommends she not go back to her mom and so does her guardian at lidium. Our lawyer is unsure of what will happen. Can we try to severe their custody rights on grounds of abandonment considering they have not seen or supported this little girl in over a year, or on the grounds that this little girl is just terrified of her mother. Do we have any legal grounds or will we be forced to give her back to a women her she is scared of.

Well you have a good chance of keeping the child from what your saying about the parents. The therapist and her opion is going to be upper most in this case. Lawyers usally are unsure they never want to make any promises they can't keep. But i think you have a strong case.Good luck
