Do we have the right to take a cell phone away?

We put a friend on our cell phone plan and she bought the phone.She is using more anytime minutes then she is suppose to be using.We have asked her several times to back off on the anytime calls and she hasn't, so we are thinking about taking her phone away.She told me I can't since she bought it, but it is in my husbands name not hers.Can we legal take it or not?

While you cannot take the cell phone, there are several things you can do to limit use on your account. Depending upon your provider rules, you can:

1) Restrict calling in or out, as well as block text messaging and internet use.

2) Put that phone on a vacation plan for a reduced rate per month, while putting restrictions on the phone.

3) Cancel service on that phone. While you might have to pay an early termination fee, you'll no longer have to deal with that person at all.

4) Set up account limits for the amount of time that phone can be used. Some providers allow you to assign minute usage on a cell phone number, with or without a fee.

5) Transfer service into their own name. This will require a credit check.

Remember, while this person may own the equipment, your husband owns the account.
