Does not paying child support become a felony?

My ex husband has been court ordered to pay child support of $363 a month. He called me middle of june, and said that he is 2 months behind on bills, that he knows he has to pay, and when he got his next paycheck, he would send me either half, or a third of it. My lawyer will be getting the paper work for child support signed bu the judge, and then pin him with contempt of court. Im just woundering if it would be a felony, because my ex has been charged with misdomenor child abuse because I picked up my son on jan 27, 2008 and the whole left side of his face was black and blue. DSS, CPS and everyone else has said child abuse

See if he pays first. If he doesnt then take him to court cause he will go to jail. If he pays then you dont want him going to jail cause he will have no income in jail.

Well so far he has paid some and is almost $2000 behind. He was already sent to jail once for a few hours, and now isnt paying again

Check your state laws and regulations on Child support. If a law is broken in repeat offense in CA, (3 strikes law) it may be considerable. if he doesnt pay up they may have the authority to intruduce more jail time, restrictions or loss of licences, and applicable court fees may apply.

Not paying child support can lead to arrest, whether or not they consider it a felony ,i dont know i just know if you are ordered to pay it and dont you can go to jail. also they put a flag on your licence and it cannot be renewed when the time comes. i just went thru a similar situation with getting a passport i had an arreare+s which i had to pay off before they would issue me a pasport. over 22 years of paying support i had a 5,000$ arrears and i had to pay it off to get my passport, but i am free and clear of any child support obligations now.
