Does the father of a child get to keep his taxes for the year if he kicks them out the house?

My cousin has a 1 year old boy and she lives in california. She worked at Smith's for about 6 months in New Mexico. The father claimed the child for this past years taxes. He got 6000 back and now he wants to kick her and the child out of the house. She didn't claim the child for the past year. Does she have the right to take half of the tax money from the father?

Since they are not married - meaning they could not file a joint return - then legally, she has no right to any part of his tax refund.
